Inviting Suggestions on Draft India Data Accessibility & Use Policy 2022

The draft India Data Accessibility and Use Policy was published on MeitY website on February 21, 2022. Since its publication, MeitY has been receiving several comments and suggestions on the draft policy. It’s also observed that there is a need to bring in some more clarity with regard to some of the clauses in the draft policy so that the objectives of the Data Accessibility policy to enable better services is made amply clear. These clauses will be finalized after getting inputs of stakeholders in the consultation process Accordingly the draft policy document for consultations is being shared here.

Data accessibility & policy needs to be robust. We are fully dependent for electronic networking. We have seen what has happened in Russia & Ukraine.We are moving to a cashless economy. In case of wars how prepared are we. In electronic age warfare is disturbing the network to paralyze the economy. We are highly populated cash problems could be enormous.Most of the transactions happen on internet or mobile banking. We may have Rupay or Bhim but connectivity will be an issue if our towers or Servers are attacked.We load information on cloud I don't know whether the cloud server is within India or outside.How are we sure we will have connectivity if the serveroperation falls in a hostile country. If one area is attacked whether systems are in place to isolate that area instead of loosing the entire grid of network. From TV network can we have internet access in individual houses or offices through satellite. Can the systems be upgraded for these systems. Its my view not knowing much.

voter card and aadhat card should be same and at the time of voting only biometric system must be implemented so that fack votes are not put the machine is activated only by the biomatrick system.

A data-sharing toolkit will be provided to all ministries to “help assess and optimally manage risk associated with data sharing and release”, the policy revealed. It will help data officers to identify whether the dataset qualifies for release, restricted sharing, or needs to be on the negative list, identify the appropriate release mechanism, and the required degree of anonymisation.

All government data will be open and shareable unless it falls under a negative list of data sets. Data categorised under the negative list of datasets that won’t be shared, and restricted access and shared only with trusted users, as defined by the respective ministry or department, under the controlled environment.

All ministers or departments should receive a data-sharing toolkit to help assess and manage risk associated with data sharing and publication. The framework will assist data officers in determining whether a data set qualifies for release, restricted sharing, or must be placed on the negative list, as well as the proper release channel and degree of anonymity required.

India does not have a data protection law (Data Protection Bill) that can provide accountability and remedy for privacy violations such as coercive and excessive data collection or data breaches. Here, inter-departmental data sharing poses concerns related to privacy since the open government data portal which contains data from all departments may result in the creation of 360 degree profiles and enable state-sponsored mass surveillance.

While adopting the language of open data it strays from its core principle of providing transparency of the Government towards its citizens. There is only one mention of transparency and little to no mention of how such data sharing will help ensure demands for accountability and redress.

Hi! The Govt must allow easy access to the details of public sector departments. It must display the number of active users with the active and inactive programs. But before allowing access to online data the Govt must nullify online impersonation by imposing heavy penalty with imprisonment. Thank you!
