Ministry of Women and Child Development has formulated a draft Bill on “Trafficking of Persons (Prevention, Protection and Rehabilitation) Bill, 2016” for further consultations with all stakeholders. It aims to create a strong legal, economic and social environment against trafficking of persons and for matters connected therewith or incidental thereto.

The draft Bill has taken in to account the various aspects of trafficking and its punishments as defined in section 370- 373 of Indian Penal Code, 1860 and aims to include other offences/ provisions which are not dealt in any other law for the purpose of trafficking, such as (1) penal provisions for the disclosure of identity of the victim of trafficking and witness (2) use of narcotic drug or psychotropic substance or alcohol for the purpose of trafficking (3) use of chemical substance or hormones for the purpose of exploitation. The draft Bill has also taken in to its ambit the ‘placement agencies’ by making mandatory for them to also register for the purposes of this Act.

The proposed draft Bill aims to place dedicated institutional mechanism at District, State and Central level. It also envisages a designated Agency for the investigation of offences. It provides for Protection Homes and Special Homes for short term and long term rehabilitation support. For speedy trial with a view to increase prosecution and to reduce the trauma faced by the victims, the proposed draft Bill provides for establishing Special Courts in each district and experienced Special Prosecutors. Recovery of back wages and other monetary losses of the victim of trafficking is also proposed.

The draft Bill provides for mandatory reporting within 24 hours by a Police Officer, Public servant, any officer or employee of Protection Home or Special Home having custody of the victim of trafficking to the District Anti-Trafficking Committee or in case of child victim to the Child Welfare Committee. For the effective implementation of the proposed Act and for the welfare and rehabilitation of the victims an Anti- Trafficking Fund will be created.

Victims to be legal heirs of Assets of Organizations/People involved in this activity. Government should liquidate those assets ( 50% can be used as rehabilitation fund and 50% to be given to the victim)

There should be provision of help desk in this regard at every railway station and public should be made ware of the provision so that children or any person lost there can be found by approaching the same railway station. Secondly these desk should have tie-up with the DD News and the news immediately be flashed on the TV as soon any case is reported as every now have access to the TV and the News Channels. After making such arrangements the public needs to be informed about the same.

Toll free numbers on issues of trafficking should be displayed in institutions such as railways station, Bus stand, schools, hospitals, factories, etc… behind buses, Auto rickshaws which are easily accessible to public and even victims..district, block, panchayat, and village & ward level institutions. Youth resource centers should be established at village level with knowledge on safe migration Monitoring visits to be made by task force groups appointed by govtto check payment of DWL.

To stop girl trafficking, first & foremost job of the Government is to ban all brothels. The chain involved in this business is to be identified from the grass root level and all are to be convicted and due punishment should be give. Availability of "Chloroform" to the general public must be restricted/scrutinized. Radio tagging may be made compulsory to all the listed/ registered criminals.

1) it should be made compulsory, for parents to report their missing child, and for police to lodge complaint 2) give compulsory job security to parents to settle at different place provided they accept child back and give her complete care and love

Human trafficking incidents happens mostly in Public places, public events, public transport, Schools etc. The draft Bill should make it obligatory on Authorities to create awareness about such crime through posters, Advertisement, documentaries, conferences etc. Allocate specific fund for such events.

All people with criminal records with police Dept. must have Aadhar card.If not, please issue Aadhar card to them even if you have to go out of way. This will help to identify the clue.
