Ministry of Women and Child Development has formulated a draft Bill on “Trafficking of Persons (Prevention, Protection and Rehabilitation) Bill, 2016” for further consultations with all stakeholders. It aims to create a strong legal, economic and social environment against trafficking of persons and for matters connected therewith or incidental thereto.

The draft Bill has taken in to account the various aspects of trafficking and its punishments as defined in section 370- 373 of Indian Penal Code, 1860 and aims to include other offences/ provisions which are not dealt in any other law for the purpose of trafficking, such as (1) penal provisions for the disclosure of identity of the victim of trafficking and witness (2) use of narcotic drug or psychotropic substance or alcohol for the purpose of trafficking (3) use of chemical substance or hormones for the purpose of exploitation. The draft Bill has also taken in to its ambit the ‘placement agencies’ by making mandatory for them to also register for the purposes of this Act.

The proposed draft Bill aims to place dedicated institutional mechanism at District, State and Central level. It also envisages a designated Agency for the investigation of offences. It provides for Protection Homes and Special Homes for short term and long term rehabilitation support. For speedy trial with a view to increase prosecution and to reduce the trauma faced by the victims, the proposed draft Bill provides for establishing Special Courts in each district and experienced Special Prosecutors. Recovery of back wages and other monetary losses of the victim of trafficking is also proposed.

The draft Bill provides for mandatory reporting within 24 hours by a Police Officer, Public servant, any officer or employee of Protection Home or Special Home having custody of the victim of trafficking to the District Anti-Trafficking Committee or in case of child victim to the Child Welfare Committee. For the effective implementation of the proposed Act and for the welfare and rehabilitation of the victims an Anti- Trafficking Fund will be created.

As India is already all-round developed due to various Equality Laws-Rules in past 76 yrs or more, ALL BIASED LAWS-RULES BE ABOLISHED (they are against Constituional Guarantee of Equality). All Laws& Rules must be Just, Non-Biased (Not anti-Male or pro-Women) and fairly Enforced so. Officials, Not Detecting/Punishing False Complainants/Cases (case Hungry Officials incl. Judges will cook-up cases to increase their Nos/Powers) should be equally Punished.

Two suggestions; 1. name of bill (and later on Act) should be Anti-Trafficking of Persons..., as the bill/act is against trafficking practices.... 2. For repeat offenders, bill should have specific mention and punishment should be more severe such as 7 or 10 years of imprisonment.

RESPECTED GOI , COULD U PLEASE EXPAND THE SCOPE OF ART 21 AND 21A AND LINK IT WITH REHABILITATION FOR THE VICTIMS . REMEMBER EDUCATION IS THE LONG TERM REHABILITATION MEASURE THANK U

Hi Sir/ Team Below are few inputs which I would like to share: 1. We should have a mechanism using which we can rehabilitate the kids and women from begging on the streets because they are the first people who are exposed to human trafficking. We should have schools for the kids 2. Awareness should be given especially in areas where families have more children and the parents feel they are a burden to them. A separate body should be formed in panchayat and municipal level #MyGov

dear PM your bill is the first major step to stop trafficking of persons. please set up a dedicate a women led special central wing for preventing women trafficking & child trafficking. provide it the req. full technological access i.e. centrally integrated Arti. Intel. computer face detection network.provide connect. access to all state's & rly station's ,allcities & busstand's cctvnetwork & v.c. facility and access to scrb,mho,allconcern wings.timebound response must n online monitor is good

Railway Protection Force should be empowered to arrest and prosecute offenders under this act, if offence committed in railway areas.

chapter III-para 5 (2)--Transport secretary may be included in state #anti-trafficking committee.officer from railways/airways may also be included.transporting agencies are major stake holder in containing trafficking.

chapter II- para 3 (2)-- one officer from railways/roadways/airways should be included in the district committee to involve transporting agencies.railway protection force from railways, DTO from roadways and CISF from airways may be think off.

The recommendations enumerated in the enclosed document have emerged as a result of Justice and Care's hard work through collaborative casework with the police across India, over the past eight years, on mainly three types of human trafficking cases; Sex Trafficking , Child Labour and Bonded Labour and Missing Persons. We strongly feel that without the inclusion of the mentioned aspects the Draft Bill, 2016 remains in-cohesive and toothless in tackling the complexities of Human Trafficking
