The Government of India intends to introduce the Goods and Services Tax (GST) in the country at the earliest. GST seeks to subsume many indirect taxes at the Central and State level. The proposed dual GST envisages taxation of the same taxable event, i.e., supply of goods and services, simultaneously by both the Centre and the States.

The Constitution (One Hundred and Twenty-Second Amendment) Bill, 2014, has been introduced in the Parliament for facilitating the introduction of GST in the country. Simultaneously, committees comprising of officers from the Central Government, as well as the State Governments, have been constituted for the drafting of Model CGST, SGST and IGST laws, and GST business processes of registration, refunds, returns and payments.

The draft Model CGST, SGST and IGST laws, along with GST business processes for filing of returns, shall be put up for inviting comments of stakeholders in due course. Presently, the draft business processes on GST registration, GST refunds and GST payments are being published.

The Report of the Committee on GST Refunds is available here. Comments and views are invited on these business processes by 31st October, 2015. Users are requested to keep in mind the guidelines for posting their comments:

If government can reduce the stamp duty on assets (land, home, offices, etc.) and increase the circular rate. This will help to reduce the amount of black money being generated from purchase/sale of land, house, etc, and will not effect on the government income. And later on, government can get more tax based on that value ! #GST, #ReportonReturns, #GoodsandServicesTax, #Departmentof Revenue, #MyGov

#GSTRefundSituations:If the sale invoice is not realised and GST of sale invoice is paid to Govt.Trade should get the Relief of GST paid in case of Bad Debts.

#GSTRefunds:As per Refund procedure, to avoid the unjust enrichment requirement of certification is included. This is a backwardly step. The PM of India is showing immense trust in Trade and accordingly suggested the self certification. Specially when everything will be on GSTN platform and online, why this kind of certification is required.

#GSTRefunds: There should be adequate safe guard for the business for refund in a situation where state/centre do not pay the installment each other. Business should suffer due to unresolved issues between state/centre in any case.

#GSTRefundSituations:If the amount is allowed by adjudicating Authority by an order or by any court order, the refund should be made available online in favor of registered for set off in place of compulsory transmission of funds through banking channel. The Order in Original should have online credit Reference No. in case of adjudicating Authority. In case of Court order ( as currently nor integrated with GSTN),the rectification order should compulsorily passed online by competent authority
