The Ministry of MSME is in the process of amending the MSMED Act, 2006. In this regard, this Ministry had consulted various central Ministries/Department/State Govt./Industry Associations/other stakeholders & general public.

Based on the consultations and written inputs received from various stakeholders, the amendments proposed in the MSMED Act, 2006 are based on the following four key pillars:

A) Enhancing inclusivity and broad-basing the scope of the Act;
B) Future-proofing the Act;
C) Improving co-ordination under the Act;
D) Enhancing the ease of business in the ecosystem;

A) Enhancing Inclusivity and Broad-basing the scope of the Act
• Accord statutory status to Udyam registration for availing benefits under the Act.
• Provision for credit guarantee coverage to Micro and Small Enterprises by Government.
• Enabling provisions to address issues of credit gap; shortage of working capital; ensure adequate, affordable, and timely finance to enterprises; minimize the incidence of financial stress among enterprises; and leverage new and emerging platforms and technologies such as the Trade Receivables Discounting System, Account Aggregator Framework, etc.
• Provision for targeted mechanisms for capacity building of women, members of SC and ST, and rural artisans and craftspeople and provisions for market access, financial and digital literacy.
• Inclusion of cottage, village, and coir industries as rural artisans and craftspeople in the MSME classification scheme, to promote rural industries and enterprises.
• Inclusion of Medium Enterprises in the dispute resolution framework

B) Future-proofing the Act
• Strengthen provisions for technological upgradation and green technology to enhance productivity, quality, and competitiveness.
• Enabling provisions for the adoption of energy-efficient, sustainable technologies by MSME.
• Designation of a Green Fund to support the energy transition of MSME and integration in the global value chain.
• Addressing industrial obsolescence among enterprises.
• Promoting technological upgradation and research and development among enterprises.
• Encouraging the adoption of sustainable technology solutions by enterprises.

C) Improving coordination
• Streamline the structure, working, and functions of the National Board and the Advisory Committee to make them lean, efficient, and responsive to the requirements of MSME, and strengthen the monitoring and evaluation mechanism.
• Provision to set up an adequate number of Facilitation Councils in States for better access to MSMEs, along with an incentive structure to promote competition and good performance among them.
• The composition of the Facilitation Councils may be prescribed by the State Government.

D) Enhancing Ease of Business in the Ecosystem
• Provisions for the decriminalisation of offences by converting criminal fines into civil penalties.
• Simplification of regulatory clearance mechanism and procedure for establishment and management of MSME by making suitable provisions in the Rulemaking powers of the appropriate Government.
• Creating and encouraging the adoption of digital solutions to improve transparency and foster a culture of accountability
• Make the adjudication process simpler and speedier, aligning it with the alternative dispute resolution framework and online dispute redressal.

Minimum salary define for Private and public sector. ( Like minimum salary defined should be 22000 across the sector but can grow depending on grade) No Pension for Government employees but should have some fixed pension for every citizen after 65 years of age to accomodate retirement years. (Minimum 20 years of taxable work income). Provident fund slabs should be selected by the employees and some government contribution if you contribute specific threshold in a year. Higher tax rate for the people who earn more than 50 lacs like 39 %. They can do some donations and that should be tax free. Online portal should be developed where people can learn new skills according to the trade. This should be zero fees scheme so that people can reap the benefit of it. Women development should have happen where short term courses will be provided free of cost to the women. This is really helpful to make women self- reliant and skilled to survive and do business.

Limited Skilled Workforce: Many MSMEs struggle to find workers with the necessary skills to operate advanced machinery or implement new technologies. This can lead to inefficiencies, production delays, and reduced product quality. Limited Branding and Outreach: MSMEs often lack the resources and expertise to effectively market their products and build brand awareness. This makes it difficult to compete with larger companies or established brands, especially in the online marketplace. Infrastructure Constraints: Inadequate infrastructure, such as poor road connectivity, unreliable power supply, and lack of access to modern facilities, can significantly hinder the operations and growth of MSMEs. A small food processing unit in a rural area may face challenges in transporting its products to markets due to poor road conditions or may experience frequent disruptions in production due to erratic power supply.

AI-powered Mentorship Programs: Developing AI-powered mentorship program that provides MSMEs with personalized guidance and advice based on their specific needs and industry data. This can bridge the gap in mentorship access, especially for MSMEs in remote locations. Embracing Digital Transformation: In the digital age, MSMEs must embrace technology to remain competitive. This includes leveraging e-commerce platforms, adopting digital marketing strategies, and implementing automation and digitization in their operations. Initiatives like upskilling programs, digital literacy campaigns, and incentives for technology adoption can drive this transformation. Fostering Sustainable Entrepreneurship: Encouraging sustainable and socially responsible business practices among MSMEs can create a positive impact on the environment and society. This can include promoting eco-friendly production methods, supporting green entrepreneurship, and incentivizing the use of renewable energy sources

MSME Innovation Hubs: Establishing physical or virtual MSME innovation hubs. These hubs could connect MSMEs with industry experts, researchers, and mentors. They would facilitate knowledge sharing, co-creation of innovative products, and access to advanced technologies or design expertise. An MSME apparel manufacturer can collaborate with a design expert at the hub to develop a new clothing line, fostering innovation and market differentiation. Blockchain-Powered Smart Contracts: Leveraging blockchain technology and smart contracts can revolutionize the payment cycle for MSMEs. A blockchain-based platform could be developed to facilitate secure and transparent transactions between MSMEs and their clients (larger enterprises or government agencies).

In MSME Sector there are:- Delayed Payments: One of the major challenges faced by MSMEs is the issue of delayed payments from larger enterprises or government agencies. This can severely strain their working capital and cash flow, hampering their ability to operate smoothly. A small supplier or contractor may face significant financial difficulties due to delays in receiving payments for goods or services rendered, jeopardizing their business continuity.

I am requesting the Ministry of MSME & Prime Minister Modi ji to look over this issues in MSME:- Lack of Adequate Access to Finance: Despite government schemes like Mudra loans, obtaining credit remains a major challenge for MSMEs. Traditional banks often perceive them as high-risk borrowers due to limited credit history and collateral. This restricts their ability to invest in expansion, innovation, and working capital.

To enhance the effectiveness of the MSMED Act, 2006, I recommend focusing on enhancing digital infrastructure and capacity-building initiatives for MSMEs. Introducing provisions that promote digital transformation, such as subsidies for adopting digital technologies and creating digital literacy programs, would enable MSMEs to streamline operations, expand market reach, and improve competitiveness. Moreover, facilitating easier access to digital platforms for regulatory compliance and financial transactions could significantly reduce administrative burdens and enhance ease of doing business. These measures would not only empower MSMEs to thrive in the digital age but also contribute to broader economic growth and resilience. Collaborating with industry experts and stakeholders to develop tailored support programs would ensure that these initiatives are effectively implemented and yield tangible benefits for MSMEs across diverse sectors.
