केंद्रीय बजट 2015-16 के अपने बजट भाषण में वित्त मंत्री ने ठेके से संबंधित विवादों के समाधान के लिए संस्थागत व्यवस्था को कारगर बनाने की आवश्यकता पर बल दिया और लोक संविदा लागू करने के लिए विधेयक (विवादों के समाधान) का प्रस्ताव रखा। वित्त मंत्री के बजट भाषण का प्रासंगिक अंश इस प्रकार हैः

1. “सार्वजनिक ठेके में उत्पन्न होने वाले विवादों को हल करने की प्रक्रिया में काफी समय लगता है तथा यह प्रक्रिया महंगी भी है। मेरी सरकार इस तरह के विवादों के समाधान तथा संस्थागत व्यवस्था को कारगर बनाने के लिए, लोक संविदा (विवादों के समाधान) बिल पेश करने का प्रस्ताव रखती है”।

2. तदनुसार, लोक ठेके का प्रारंभिक मसौदा (विवादों के समाधान) विधेयक, 2015 तैयार किया गया है। प्रस्तावित कानून पीपीपी परियोजनाओं सहित परियोजनाओं के निर्माण और बुनियादी परियोजनाओं के लिए लोक प्राधिकरण द्वारा किए गए अनुबंध के साथ सौदा करने के लिए परिकल्पना की गई है।

3. विधेयक के मसौदे पर हितधारकों की टिप्पणी/विचार प्राप्त करने के लिए संलग्न किया गया है। विचारों को साझा करने के लिए अंतिम तिथि/समय 30 जून 2015, शाम 5:00 बजे तक है।

Dear madam, I am writing you to highlight the atrocities to the serving sailors,soldiers,airmen. They all are recruited and trained in their allotted trades by the defence. But the biggest irony is that none of the courses and training offered are recognised by the UGC nor these are affiliated to any university. So the highly trained and skilled jawan when retires at an early age of32-35 years, his qualification is nil. He gets nothing. My request to you is that A UNIVERSITY OF DEFENCE BE ESTABLISHED just as done by our PM in Gandhinagar. This historic move will place our government back into the hearts of the jawans. A bad image of our PM has been created by some rogue elements on OROP issue. The jawans retiring after 15 years of more are being given some funny 'equavalant to graduation' certificate which has no educational value. Jawans are being cheated by the officers so that they will not face competition from them in higher posts after retirement. To cover all this up, jawans pre release courses offered but they too are of no educational value. Retiring Officers are offered courses in IIMs an IITs. The jawans re allotted hair cutting technology course.

Civil society kupwara has taken a serious note of negligent approach of jk government, jk Education department as it fails to come up with short list of those candidates who have applied for accountant ,Je ,resource teachers and class iv posts under serva shiksha abhyan (SSA) scheme in 2014 .Despite lapse of two years the department is paying no heed to the issue and is least bothered about the wastage of precious time and burning issue like un- employment.This is the final intimation to the Jk government,jk Education department in this regarding to settle the issue within two weeks time otherwise be ready to face the legal way.

20 Section 37 (2) 180 days appears to be un realistic.

21 Section 47 is contrary to the intent why this act is being introduced.
22 Section 48 proviso to section 48 (1) should be done away with it as it contradicts section 47 because no such restriction can be placed

19 Section 30 and 35
Section 35 subsection 2 Section 35 subsection 4
Section 35 subsection 5 appears to be contradictory. On the one hand section 30 states that the same is binding (shall have the same status as any other arbitral award) and no challenge shall lie, where as section 35 states that it shall be placed before this tribunal for the parties to accept. These powers are vast, and should be curbed to exclude matters of criminal or tortuous natureshould be done away with as infrastructu

CFI...17 Section 30 (6) Should include injunctions and other preliminary prohibitory/ preventive measures
18 Section 33 subsection 8 Powers should be given to the arbitrators to modify the interim orders to be mad workable or wherever parties consent. If no powers are given un necessary time shall be wasted and parties may have to approach this tribunal with appropriate application which may cause delay.

CFI...15 Section 25 sub section 3 Section 25 subsection 1 states that the issues and additional issues shall be framed by this tribunal. What will happen in case parties realize during the course of the matter pending before the arbitral tribunal that additional issue is required to be framed.
will it not tantamount to re writing of a contract by this tribunal.
16 Section 29 period of 120 days appears to be non realistic.
